ORDER The present Criminal Original Petition has been filed by A1 and A2 in Crime No.292 of 2026, on the file of the first respondent police seeking to quash the FIR, wherein they are charged with the offences under Sections 223 (a) and 132 of BNS, 2023.
2. A perusal of the records reveal that the petitioners have lodged a complaint as against the neighbours that they are attempting to grab their land. The complaint was lodged on 11.05.2026 before the respondent police and similar complaint was lodged before the District Collector on the same day.
3. The contentions of the FIR reveal that on 19.05.2026, the petitioners had appeared in the police station and protested for not initiating any action on the complaint lodged by the petitioners. Therefore, the present FIR has been registered. 2/5 https://www.mhc.tn.gov.in/judis

4. According to the learned counsel appearing for the petitioners, the petitioners had only gone to the police station to enquire about the status of their complaint and nothing untoward had happened. There is no allegation whatsoever that they had misbehaved or attacked the police officials.
5. Heard the learned counsel appearing for the petitioners and perused the materials available on record.

It could be seen from the averments in the FIR that the petitioners herein, who were aged about 67 and 60 years have gone to the police station to enquire about the status of the complaint lodged against their neighbours with regard to the land grabbing. In such circumstances, the action cannot be considered to be criminal in nature. In such circumstances, continuation of criminal proceedings as against the petitioners would only be an abuse of process of law. 3/5 https://www.mhc.tn.gov.in/judis

7. Considering the above said facts, the FIR in Crime No.292 of 2026, on the file of the first respondent police, is hereby quashed. Accordingly, this Criminal Original Petition is allowed. Consequently connected Miscellaneous Petition is closed.
