(AD 62)
(S. Banerjee) WPA 8336 of 2026
Ganesh Mondal Vs. The State of West Bengal & Ors. Mr. Nirmalendu Bera Mr. Gora Chand Samanta Mr. Atanu Banik
…for the petitioner Mr. Gouranga Kumar Das Mr. Bishal Maity Ms. Tithli Piplai
…for the respondent nos. 5 to 11
1. This writ petition has been filed by the petitioner against the respondents along with his wife and other in-laws for a direction upon the respondent nos. 2 and 3 to perform their statutory duties and to take necessary legal steps against the private- respondents for their criminal activities and/or proper investigation to such criminal activity. 2. Affidavit of service filed reflects that the copy of this writ petition has been served upon the respondents. 3. Learned advocate appearing for the respondent nos. 5 to 11 submits that she has had no communication with her client. 2
4. Upon hearing the learned advocate appearing for the petitioner and upon perusal of the writ petition it appears that a complaint was lodged before the Court of the learned ACJM, Kakdwip, South 24 Parganas under Sections 115(2)/303(2)/318(3)/61(2)/126(2)/351(2)/3(5) of the BNSS pursuant to which an order was passed by the learned Magistrate whereby the said complaint has been registered as CR Case directing the complainant to file requisite. Thereafter, the dates have been fixed for hearing on SA. It further appears that the next date is fixed on January 28, 2026 for SA and order. However, the learned advocate for the petitioner is not in a position to appraise this Court of the exact status of the said proceeding. 5. It further transpires that on March 24, 2026 a complaint has been filed by the petitioner before the Superintendent of Police and the Officer in- Charge of Dholahat Police Station and the Sub Divisional Officer, Kakdwip with a prayer for taking legal steps against the respondents for their illegal and criminal activities. 6. In view of the overall situation this Court is of the considered view that while the concerned respondent may be directed to deal with the matter
3 in accordance with law, no further direction can be passed in this regard, particularly when the petitioner has already approached the appropriate forum by instituting a criminal case. 7. Hence the respondent no.
3 is directed to do the needful in respect of the complaint lodged in accordance with law at the earliest. 8. Accordingly this writ petition stands disposed of. 9. Parties to act on the server copy of the order. (Chaitali Chatterjee (Das), J.)
