ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 11.05.2023, for the offences punishable under Sections 8(c), 20(b) (ii)(C), 29(1) and 25 of NDPS Act, in Crime No.374 of 2023 on the file of the 1/4 https://www.mhc.tn.gov.in/judis
Crl.O.P.(MD)No.12649 of 2026 respondent police, seeks bail.
2. The case of the prosecution is that the petitioner joining hands with other accused found in possession of 2090 kilograms of Ganja. Hence, the case.
3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. The petitioner is in custody from the year 2023. Hence, he prayed bail for the petitioner.
4. The learned Counsel appearing for the State reiterated the prosecution case and reported that earlier bail application filed by the petitioner was dismissed by this Court on 30.04.2026 on merits. There is no change of circumstances in this case. He opposed the grant of bail to the petitioner.
5. This Court heard both sides and perused the materials available on records. 6.Considering the facts and circumstances of the case, that the earlier bail application filed by the petitioner in Crl.O.P.(MD).No.21694 of 2026 was 2/4 https://www.mhc.tn.gov.in/judis
Crl.O.P.(MD)No.12649 of 2026 dismissed on 30.04.2026 on merits. In view of the same, this Court is not inclined to reconsider the same, since it was dismissed on merits of the case. 7.Accordingly, this criminal original petition stands dismissed.
