JUSTICE R.K. PATTANAIK Order No. ORDER 16.03.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Air Field P.S. Case No.18 of 2026 corresponding to C.T. Case No.60 of 2026 pending in the court of learned J.M.F.C.-I (Cog. Taking), Bhubaneswar on the grounds stated. 3. Perused the FIR as at Annexure-1 and it reveals that unknown miscreants have committed robbery snatching away bracelet, chain, gold rings etc. It is informed to the Court that the ornaments have been recovered and seized by the local police. The further submission is that the co-accused, namely, Kishan Behera has been granted bail by the learned Sessions Court and while claiming so, a copy of the order dated 10th February, 2026 in BA No.241 of 2026 is produced for the Court's perusal. It is claimed that the petitioner apprehends arrest since he is having two other criminal cases, not of recent one. The investigation is stated to be still in progress. Recorded p. 2 the objection of the State. Considering the submission as above and allegations in the FIR i.e. Annexure-1, this Court is not inclined to consider the plea of pre-arrest bail of the petitioner, however, is of the view that he should be directed to surrender before the learned court below seeking regular bail pleading parity for orders on merit. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders within a month from today before learned J.M.F.C.-I (Cog. Taking), Bhubaneswar in connection with Air Field P.S. Case No.18 of 2026 corresponding to C.T. Case No.60 of 2026 and moves regular bail, it shall be duly considered and in case rejected during the first hour, to approach the learned Sessions Court during the second hour for orders on the same day considering the plea of parity and for the said purpose, the relevant record shall be made available. 6.
