C.M.P.(MD)No.7230 of 2026 has been filed to clarify the judgment, dated 26.11.2025, made in A.S.(MD)No.142 of 2018. 2.C.M.P.(MD)No.7231 of 2026 has been filed to stay all further proceedings in O.S.No.171 of 2008 on the file of the 3rd Additional District Court, Trichy pending disposal of the above said interlocutory 2/5 https://www.mhc.tn.gov.in/judis C.M.P.(MD)Nos.7230 and 7231 of 2026 application. 3.In the above first appeal, this Court, after hearing both sides, remitted the matter back to the trial Court and had directed that the trial Court shall examine the evidence already on record, considering the written arguments already submitted, hear the arguments and then pronounce judgment answering all issues framed. However, in the course of the judgement, it had also been observed that the petitioners/defendants in the suit had not tendered any evidence. They had, however, filed a written statement. Hence, the petitioners seek clarification whether the petitioners are permitted to tender evidence. 3.After hearing both sides, it is clarified that both the plaintiffs in the suit and the defendants in the suit are permitted to tender additional evidence, however, we would fix a time limit for the said process to be completed and we would direct that the tendering of evidence by the plaintiffs and by the defendants and the pronoucement of judgment in the suit should be completed on or before 30.11.2026. It is clarified that if 3/5 https://www.mhc.tn.gov.in/judis C.M.P.(MD)Nos.7230 and 7231 of 2026 the plaintiffs are tendering evidence, only those additional witnesses could be cross examined by the defendants and PW-1 and PW-2 cannot be recalled for cross examination. 4.Accordingly, C.M.P.(MD)No.7230 of 2026 is closed. 5.In view of the order passed in C.M.P.(MD)No.7230 of 2026, C.M.P.(MD)No.7231 of 2026 is closed.
