CORAM : SRI ANANDA SEN, J. ---- For the Petitioner: Ms. Sangeeta Singh, Advocate
[Through Video Conferencing]
Mr. Anurag Kumar, Advocate For the State:
Ms. Ruby Pandey, A.P.P. ---- 02/27.02.2026 Heard learned counsel for the petitioner, appearing through video conferencing, and learned A.P.P. appearing for the State. Learned counsel for the petitioner did not complain about the video or audio quality or any connectivity issue during proceedings of the Court through video conferencing.

By way of this bail application, the petitioner prays for grant of regular bail in connection with Bankmore (Bhuli O.P.) Police Station Case No.163 of 2025, registered for offences under Sections 64(2)(m), 89, 126(2), 115(2), 351(2), 352, 3(5) of the Bharatiya Nyaya Sanhita, pending in the Court of the Chief Judicial Magistrate, Dhanbad.
3.
This police case arises out of complaint. Complainant states that she is in the process of getting divorce, when she became acquainted with this petitioner. This petitioner got her introduced with his sister and mother and thereafter assured that he will marry her after she gets divorce by order of the Court. It is further alleged that on the pretext of marriage, physical relation was established. Before that this petitioner had put vermilion on the head of the complainant. Both of them started residing as husband and wife. She became pregnant and attempt was made to abort the pregnancy by this petitioner. It is stated that this petitioner kept her in the flat, but fled. Ultimately, on 03.03.2023, son was born out of the said physical relationship. It is stated that the petitioner, thereafter, did not marry. All of a sudden in July 2023, petitioner started talking with the complainant over mobile, and the complainant came to know that the petitioner is residing at Bangalore along with accused Anand Thakur. Thereafter the petitioner and accused Anand Thakur instigated the complainant to go to Bangalore. The complainant along with the wife of accused Anand Thakur went to Bangalore on 08.01.2025. She also took her

child. There also the petitioner established physical relation with the complainant giving her status of wife and the complainant again became pregnant. On knowing this, the petitioner assaulted the complainant due to which the complainant was seriously injured and she got her treatment in a government hospital at Bangalore.
4.
Learned counsel for the petitioner submits that the entire allegations are false, frivolous and concocted. She submits that admittedly, the complainant/informant is a major married lady and from the nature of allegations also it transpires that relationship was consensual. The allegations regarding inducement on the pretext of marriage is highly unbelievable.
Learned counsel submits that no offence alleged is attracted against the petitioner and the instant case is nothing but a misuse of the process of law in
order to extort.
5.
Learned A.P.P. appearing for the State vehemently opposes the prayer for bail of the petitioner.
6.
From the petition and from the arguments of the parties, I find that the victim woman is major. She was in the process of getting divorce from her husband, when this petitioner became acquainted with her. It is also admitted that they started living as husband and wife and they entered into physical relationship. All these happened in 2022-23, i.e., before the formal divorce was granted by the Court. Knowing fully well about all these consequences, parties entered into the relationship and now the failed relationship has been converted into this criminal case.
7.
Considering the above facts and circumstances of the case, I am inclined to grant bail to the petitioner. Petitioner, namely, Hitesh Singh @ Hitesh Kr. Singh is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Dhanbad in connection with Bank More (Bhuli O.P.) Police Station Case No.163 of 2025, subject to the condition that one of the bailers should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand.
