ORDER 27.04.2026 Heard Mr. B Saikia, learned counsel appearing on behalf of Ms. S G Baruah, learned counsel for the applicants. Also heard Ms. M Barman, learned Government Advocate, Assam for the respondents. By way of this interlocutory application, the applicants are seeking restoration of the connected WP(C) No. 3693/2018 by recalling the order dated 09.06.2025, whereby the writ petition of the applicants was dismissed for non- prosecution. It appears that the applicants had filed the connected writ petition involving non-payment of the amount for completion of the allotted training course modules under the skill development initiative scheme. It appears that during the pendency of the writ petition, the engaged counsel having not appeared before the Court, the writ petition was dismissed for non-prosecution on 09.06.2025.
Learned counsel for the applicants submits that the applicants were not aware of the non-appearance of their earlier engaged counsel on 21.05.2025 and 09.06.205 and that they were handed over the brief of the case by their
Page No.# 4/4 earlier engaged counsel, stating that the matter was disposed. Later on, the applicants when consulted another advocate, came to know about their case being dismissed for non-prosecution. Thereafter, the applicants approached the respondent authorities and who informed them that their pending bills were at the final stage of payment. As nothing progressed, they engaged another advocate and filed the instant interlocutory application for restoration of the connected WP(C) No. 3693/2018, stating that great irreparable loss and injury would be caused to them if the order dated 09.06.2025 is not recalled and the writ petition is not restored to its original file. Ms. M Barman, learned Government Advocate, Assam does not oppose to the writ petition being restored. Having heard the learned counsels for the parties and having considered the facts and circumstances of the case, in the interest of justice, the order dated 09.06.2025 passed in the connected WP(C) No. 3693/2018 is hereby recalled. Consequently, WP(C) No. 3693/2018 is restored to its original file. The instant interlocutory application is allowed and disposed of.
