Learned advocate for the State produces the case diary and has drawn the attention of the court to the post- mortem report as also the opinion of doctor. It has also been pointed out that one of the accused is still absconding, as such, the case has not been committed to the court of Sessions. Having considered the conduct of the present petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. 2 However the learned Magistrate in seisin of the case would take steps for splitting up of the trial, if required, and, thereafter, proceed for committal proceedings.
