These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.91/2026 registered at Police Station Shipra Path, District Jaipur City (South), for the offence(s) under Sections 189(2), 331(3), 305(a), 329(3) and 324(5) of BNS. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. It is [2026:RJ-JP:15521] (3 of 5) [CRLMB-2961/2026] contended that the charge-sheet has already been submitted and the matter is exclusively triable by the Magistrate. It is further contended that the accused-petitioners namely; Sardar Singh, Sudhir Sharma, Shankarlal and Rinku Singh are in custody since 06.02.2026 and accused petitioner- Pankaj Gurwani is in custody since 17.02.2026 and the trial of the case may take considerable time, therefore, the bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor as well as learned counsel appearing on behalf of the complainant have vehemently opposed the bail applications. It is contended by learned counsel for the complainant that the accused-petitioners are operating a gang and in order to grab the property of the complainant, they came with a JCB and demolished the entire structure made on the disputed land. They also took away with them 20 AC compressor, 500 chairs, 350 Sofas etc., belonging to the complainant. It is further contended that the entire incident was captured in the CCTV. It is also argued that the accused-petitioner- Sudhir Sharma, uploaded the video of the incident on Facebook and threatened the complainant to bear the consequences. It is also argued that the petitioners’ modus operandi was to lodge the civil suit and obtain an interim order and thereafter forcibly entered into the property. It is further contended that against the accused petitioner- Pankaj another FIR bearing No.102/2026 was also registered under the provisions of Arms Act and there are 06 and 03 other cases pending against the accused-petitioner Shankarlal and Rinku respectively under various provisions of BNS and IPC. Therefore, [2026:RJ-JP:15521] (4 of 5) [CRLMB-2961/2026] considering the gravity of the offence, the bail application of the accused-petitioners may be dismissed. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioners and taking note of the fact that matter is exclusively triable by Magistrate, accused petitioners are in custody since long and further trial of the case may take considerable time, therefore, without expressing anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely; 1. Sardar Singh @ Pappu S/o Chaju Singh, 2. Sudhir Sharma Urf Gopal S/o Shree Ram Kishan, 3. Pankaj Gurwani S/o Bhagwan Das Gurwani, 4. Shankarlal S/o Late Kishanlal and 5. Rinku Singh S/o Sahabsingh, in connection with FIR No.91/2026, registered at Police Station Shipra Path, District Jaipur City (South), shall be enlarged on bail provided they furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for there appearance before the court concerned on all the dates of hearing and as and when called upon to do so. The learned trial Judge shall also verify the addresses and the contact details of the surety through concerned S.H.O. before releasing the accused- petitioners on bail. 7. The accused-petitioners namely; Pankaj Gurwani, Shankarlal and Rinku Singh are directed to mark their presence on 25th of every month before the concerned Police Station till conclusion of [2026:RJ-JP:15521] (5 of 5) [CRLMB-2961/2026] the trial. The SHO of the concerned Police Station is directed to maintain a regular register marking the presence of the aforementioned accused-petitioners and shall send the presence report on the same day to the concerned trial Court every month without any delay. 8. The accused-petitioners namely; Pankaj Gurwani, Shankarlal and Rinku Singh are further directed to submit their present addresses along with their mobile numbers to the concerned S.H.O. within 7 days from their release and the concerned S.H.O. shall verify the said addresses and the mobile numbers. In case if the accused-petitioners namely; Pankaj Gurwani, Shankarlal and Rinku Singh changes their addresses or mobile numbers they shall submit the same before the concerned S.H.O. and also before the concerned learned trial Court. In case of any breach of the aforementioned conditions, the learned Public Prosecutor shall be free to move the application against the accused-petitioners for cancellation of the bail before the concerned Court. 9.
