By way of the instant criminal miscellaneous application, the applicant prays for a direction to the learned Judicial Magistrate, Haridwar, to expedite and conclude Complaint Case No. 90 of 2022, registered under Section 138 of the Negotiable Instruments Act, 1881 within the time frame stipulated by this Court. 3. Learned counsel for the applicant submits that the learned trial Court took cognizance of the offence and issued summons to the respondent vide order dated 06.08.2022. The respondent surrendered before the Court on 02.12.2024, secured bail, and has since employed dilatory tactics, resulting in protracted delays. It is further contended that nearly four years have elapsed since the institution of the complaint, and during this period, repeated adjournments have been sought on one pretext or another, thereby causing inordinate delay and frustrating the ends of justice. 4. It is trite law that proceedings under Section 138 of the N.I. Act are statutorily mandated to be disposed of expeditiously, as ordained by the provision itself. 5. In view of the aforesaid, the 2026:UHC:1382 criminal miscellaneous application is allowed. The learned Judicial Magistrate concerned is directed to conclude the aforesaid Complaint Case No. 90 of 2022, preferably within a period of three months from the date of production of certified copy of this order.
