Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been detained for more than two years, only seven witnesses till date have been examined. The petitioner’s complicity do not relate to offences under Section 302 of the Indian Penal Code and is only restricted to Section 288 of the Indian Penal Code. Learned advocate for the State opposes the prayer for bail and submits that charges have been framed under Section 302 of the Indian Penal Code against the present petitioner as also under other relevant Sections. Trial of the case is in progress. Be that as it may, having considered the heinousness of the present offence and the gravity it relates to, as also resistance faced by the prosecution while progressing with the case, I am not 2 inclined to release the petitioner on bail.
