49 08.10.2026 Ct. No.6 b.das IN THE HIGH COURT AT CALCUTTA Circuit Bench at Jalpaiguri Constitutional Writ Jurisdiction WPA No. 2173 of 2026 Mukesh Darjee Vs. The State of West Bengal & Ors. Mr. Subham Gupta …for the petitioner. Mr. Dipankar Sen Ms. Nitiksha Biswakarma …for the State. Mr. Sanjay Saha …for respondent nos.2 & 3. The petitioner claims to be the registered owner of a heavy goods vehicle bearing registration No.WB78 7047 and seeks a direction upon the 5th respondent to unblock the vehicle and permit generation of royalty/e-challan in respect thereof. Learned counsel for the petitioner submits that on 26th August, 2026, the petitioner’s vehicle was sent for obtaining royalty/e-challan and was informed by the concerned vendor of the WBMDTCL that royalty could not be generated and the vehicle owner was advised to contact the office of the District Land and Land Reforms Officer, Jalpaiguri for getting the vehicle unblocked. Learned counsel submits that no show cause notice was served upon the petitioner prior to 2 blocking the vehicle, nor was any opportunity of hearing was granted to him by the authority. Learned counsel for the State submits that blocking of the vehicle was through the portal of the WBMDTCL and the petitioner was aware of the same althroughout. It is not in dispute that no show cause was issued upon the petitioner, nor opportunity of hearing granted to him prior to blocking of the vehicle. In view of the fact that the issue needs to be adjudicated by the concerned authority upon hearing the petitioner, the District Land and Land Reforms Officer, Jalpaiguri, being the 5th respondent herein, is directed to lift the blocking/unblock the vehicle and revisit the issue upon granting reasonable opportunity of hearing to the petitioner, in accordance with law. The entire exercise shall be completed within four weeks from the date of communication of this order. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. 3 Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
