Rules 9, 11(b), 148(1) & (2) of Companies (Court) Rules, 1956, the Official Liquidator prays this Court to pass the following Orders: (a) to take this report on record; (b) to permit the official Liquidator to call for claims from all the creditors of the company in liquidation by fixing 30 days time from the date of publication of notice in Newspapers to prove their debt / claim before the Official Liquidator; (c) to permit the Official Liquidator to publish the advertisement for calling claims in one issue of English daily “The New Indian Express” (in English) (Tamil Nadu Edition) and in one issue of Tamil Newspaper “Dina Mani” in (Tamil Nadu Edition); https://www.mhc.tn.gov.in/judis
__________ Page2 of 4 (d) to permit the Official Liquidator to dispense with requirement of Rule 148(2) of the Companies (Court) Rules, 1959, from the issue of individual notices to the creditors; (e) to direct that the cost of this application do come out from the Common Pool Fund (CPF) and upon realization of sale assets the amount taken from CPF may be recouped; and (f) to pass such order / orders as this Hon’ble Court may deem fit and proper in the circumstances of the case. O R D E R A company petition has been filed in the year 2011. By the order of this Court dated 12.01.2018, the Official Liquidator was appointed. Since no notification calling for claims has been made, now the present application had been taken out by the Official Liquidator. Having perused the report of the Official Liquidator and being satisfied with the reasons stated therein, this Court is inclined to allow the present application. Accordingly, the present Company Application stands ordered as prayed for. 2. Considering the period as indicated above, time period of thirty days to call for claims, stand dispensed with.
The Official Liquidator is permitted to issue paper publication as prayed for on or before 13.07.2026, granting time till 20.07.2026 to make claims and thereafter, submit a report before this Court on
