08.10.2026 Sl. No. 2 Court No.550 Rohan (Rejected) IN THE HIGH COURT AT CALCUTTA CRIMINAL MISCELLANEOUS JURISDICTION APPELLATE SIDE C.R.M.(M) 2338 of 2026 In Re: An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Patharpratima Police Station Case No. 89 of 2026 dated 19.03.2026 for the offences punishable under Sections 85/316(2)/80/108 of the Bharatiya Nyaya Sanhita, 2023 read with Section 4 of the Dowry Prohibition Act. -And- In the matter of: Hasibul Sekh @ Hasibul Sk. …Petitioner Mr. Kallal Kumar Basu Mr. Raj Sekhar Hota Mr. Md. Jannat ul Firdaus …for the Petitioner Mr. Debajyoti Deb Ms. Nabanita Chatterjee …for the State 1. Report submitted by the learned counsel for the State is kept with the record. 2. Learned counsel for the petitioner has submitted that the petitioner is in custody for about 6 months. Charge-sheet has been submitted and as such, there is no need for custodial detention of the present petitioner. 3. Learned counsel for the State opposes the prayer for bail. According to him, the victim was the second wife of the petitioner. The petitioner’s first wife also committed suicide by hanging. The victim committed suicide within 8 months of her marriage. The post-mortem report shows that the victim had multiple old bruises over different parts of limbs. He has also drawn the 2 attention of this Court to the statements of the victim’s mother and sister recorded under Section 164 of the Cr.P.C. according to him, considering all aspects of the matter, petitioner’s prayer for bail should be rejected. 4. I have gone through the materials on record. The statements of the neighbours of the petitioner show that the petitioner’s first wife also committed suicide by hanging. Some incriminating statements are also found against the present petitioner. The post-mortem report shows multiple old bruises over different parts of limbs. Therefore, it cannot be said at this stage that torture was not of such magnitude that the victim was compelled to end her life by way of hanging. 5. In view of such materials on record, I am not inclined to allow the prayer for bail of the petitioner at this stage. 6. Accordingly, the prayer for bail of the petitioner, namely, Hasibul Sekh @ Hasibul Sk. is rejected. 7. With the aforesaid observation, CRM (M) 2338 of 2026 is dismissed. 8. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court. 9. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Apurba Sinha Ray, J.)
