Pursuant to the order dated January 2, 2026, the report filed by the 8th respondent on behalf of the 14th respondent is taken on record. A copy of such report has been supplied to Mr. Chatterjee, learned advocate appearing for the petitioner. It has been stated in the said report that there is no road under the maintenance or jurisdiction of the PW(Roads) Directorate, Amta at the location where the alleged construction is stated to be going on. Mr. Chatterjee, learned advocate appearing for the petitioner draws the attention of the Court to several paragraphs in the writ petition, more 2 particularly paragraph 6, and submits that the Panchayat authorities have started constructing a RCC culvert over the property of the petitioner without initiating any proceeding for requisition and acquisition. Petitioner submitted a representation dated December 17, 2025 before various authorities including the Block Development Officer, Amta-II. Mr. Chatterjee submits that in spite of receipt of such representation, the BDO has not taken any step to restrain the Panchayat authorities from carrying on illegal construction work over the property of the petitioner. He further submits that no decision on the representation of the petitioner has been communicated to the petitioner till date. Learned advocate appearing for the State submits that the decision on the representation dated December 17, 2025 shall be communicated to the petitioner within the time limit as may be fixed by this Court. In the light of the submissions made by the learned advocates appearing for the respective parties, this writ petition stands disposed of by directing the Block Development Officer, Amta-II, being the 11th respondent, to consider the 3 representation of the petitioner dated December 17, 2025 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner, the authorities of the Gram Panchayat and any other interested party and communicate the reasoned order to the petitioner and others as expeditiously as possible but positively within a period of eight weeks from the receipt of a server copy of this order together with a copy of the representation dated December 17, 2025. It will be open to the BDO to conduct demarcation of the property in question through competent officials in order to arrive at a decision on the issue raised by the petitioner in the representation dated December 17, 2025. It is, however, made clear that in the event any work of demarcation is carried out, the same shall be after prior service of notice to the petitioner and any other affected party.
