Mahapatra ……For the Petitioners Mr. Lakshmi Narayan Banerjee ….For the State This writ petition has been filed seeking implementation of an order dated February 8, 2023, passed in WPA 3719 of 2019 by a Coordinate Bench of this Court. By the said order, the Coordinate Bench directed the respondents to consider the grievance of the petitioner relating to an unauthorized construction and to pass a reasoned order. Learned counsel appearing for the petitioners submits before this Court that the order dated February 8, 2023, has not been complied with. It is settled law that a second writ petition is maintainable for the purpose of implementation of an order passed in an earlier writ petition. However, this does not ipso facto mean that a writ court is obliged to execute an order passed by another court without there being any proper justification. The petitioner has other remedies available in accordance with law. Accordingly, WPA 28577 of 2025 is not entertained. However, this shall not preclude the petitioners from taking appropriate steps in accordance with law. WPA 28577 of 2025 stands disposed of. ( Kausik Chanda, J.) 2
