08.10.2026 Court No.7 Item No.11 AP HIGH COURT AT CALCUTTA CIRCUIT BENCH AT JALPAIGURI CRM (A) 787 of 2026 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Maynaguri Police Station Case No.492 of 2026 dated 01.08.2026 under Sections 329(4)/74/64/351(3) of the Bharatiya Nyaya Sanhita. And In the matter of: Majen Rishi …. Petitioner. Mr. Anirban Banerjee Mr. Soumyajit Laskar …for the Petitioner. Mr. Janardan Periwal Mr. Raj Kumar Mitra Mr. Debabrata Rai …for the State. Mr. Rounak Ghosh … for the de facto complainant. 1. The application for anticipatory bail is canvassed on the ground that the FIR against the petitioner has been registered as a counterblast to a previous FIR registered at the instance of the petitioner against the de facto complainant. 2. Counsel for the State submits that the FIR registered at the instance of the petitioner has already been investigated and charge sheet has been filed on 30th September, 2026. 3. The allegation in the present case is forcefully entered into the house of the de facto complainant and attempt to molest and rape her. 2 4. Injury sustained by the petitioner is result of the local villagers catching the petitioner in the act and being thrashed by them. 5. In the light of the above, this Court is not inclined to grant anticipatory bail to the petitioner. 6. The application for anticipatory bail is, thus, rejected. (Rajasekhar Mantha, J.)
