ORAL ORDER
1. In this writ petition, the petitioners have sought the following reliefs: a) To quash the order dated 19.12.2025 made on I.A.No.1/2025 in O.S.No.947/2025 on the file of the IV Addl. Civil Judge and JMFC, Anekal vide Annexure-H. b) To grant such other relief/reliefs as this Hon9ble Court deems fit to grant in the facts and circumstances of the case.
2. For the sake of convenience, the parties are referred to as per their ranking before the Trial Court in Original Suit.
3. The plaintiffs filed a suit in O.S.No.947/2025 before the Trial Court seeking relief of declaration and injunction. Along with the suit, plaintiffs also filed I.A.No.I under
Order XXXIX Rule 1 and 2 of CPC. The Trial Court has issued suit summons and emergent notice on I.A.No.1 to the defendant, but refused to grant an exparte order of

temporary injunction. After issuance of suit summons, the defendant appeared and filed written statement. Even thereafter, no order has been passed on I.A. Therefore, the present writ petition is filed seeking for early disposal of the said application.
4. This Court on 29.01.2026 passed an interim order directing both the parties to maintain status-quo in all respects, as on today, in relation to the suit schedule property, till the next date of hearing.
5. In view of the fact that the application is pending before the Trial Court, and having regard to the facts and circumstances of the case, this Court, without expressing any opinion on the merits of the matter, deems it appropriate to dispose of the writ petition with a direction to the Trial Court to consider and dispose of the said application as expeditiously as possible.

6. Accordingly, the following order is passed:
ORDER a) The writ petition is disposed of. b) The Trial Court is directed to dispose of the application filed under Order XXXIX Rule 1 and 2 of CPC, in accordance with law on or before end of June 2026. c) Parties are directed to co-operate for early disposal of the application. d) The interim order dated 29.01.2026 passed by this Court shall continue to be in force till the disposal of the said application by the Trial Court.
