The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, the Hon’ble Court may kindly be pleased to direct the respondent authorities to hold DPC within a period of 15 days for consideration of the case of the petitioner for promotion on the post of Senior Manager (Technical). 2 10.3 Any other relief, which this Hon’ble Court deems fit in the facts and circumstances may also be granted in favour of the petitioner.” 2. Learned counsel for the petitioner submits that the petitioner is holding the post of Manager (Technical), is eligible for promotion on the post of Senior Manager (Technical) and the said post is also vacant, however, the Respondent No. 2 is not initiating the proceedings for filling of the posts by way of promotion. Aggrieved with which, petitioner submitted a representation before the Respondent No. 2 on 29.09.2023, however, till date, the representation is not considered and decided and therefore, direction be issued to the Respondent No. 2 to take decision on the pending representation at the earliest within specified time frame. 3. On the other hand, learned counsel for the Respondents/State submits that as the grievance of the petitioner is against the Respondent No. 2, and therefore, she is not in a position to argue the case on merits. 4. I have heard learned counsel for the parties. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner in particular, submission of the counsel for the petitioner that the post of Senior Technical Manger is lying vacant since long which is a promotional post and petitioner is eligible for promotion, however, the proceedings of promotion has not been initiated, without entering into the merits of the case of petitioner, this writ petition is disposed of at this stage, directing the Respondent No. 2 to take decision on the representation submitted by the petitioner in accordance with law, expeditiously, preferably within a period of 06 weeks from the date of receipt of the order. 6. The petitioner will also be at liberty to submit afresh representation if he so desires and if such a representation is submitted along with copy of 3 this order, the concerned authority shall consider and take decision on the said representation also. 7.
