Digitally signed by VEERENDRA KUMAR K M Location: High Court of Karnataka - 2 - HC-KAR NC: 2026:KHC:1896-DB CCC No. 420 of 2025 THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MR. JUSTICE C.M. POONACHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging wilful disobedience of the order dated 28.01.2025 passed by the learned Single Judge of this Court in W.P.No.30191/2024 (LB-RES), whereby the accused was directed to issue an e-katha to the complainant. 2. The complainant already has a manual katha in respect of the land to which the complainant states was acquired by a registered sale deed. 3. The accused has filed a counter affidavit raising several issues and the reasons as to why e-katha can't be issued. It is stated that according to the information gathered by the accused a Rajakaluve passes through the said land. The accused has also filed a survey report enclosing therewith a sketch, which the - 3 - HC-KAR NC: 2026:KHC:1896-DB CCC No. 420 of 2025 complainant states that it is a wrong report. The accused has also filed an additional affidavit enclosing therewith two circulars dated 20.04.2016 and 17.02.2025, which according to the accused is required to be followed for issuance of e-katha. 4. In view of the above, we are unable to accept that non- issuance of e-katha constitutes any wilful disobedience of the order passed by this Court. We close the present complaint with liberty to the complainant to file a fresh writ petition, if so advised, for examination of the averments made in the counter affidavit and the additional affidavit, as concededly the said issues were not placed before the learned Single Judge.
