05/ 20.03.2026 This petition has been filed for modification of the order dated 26.06.2018, passed in A.B.A. No. 7160 of 2017 by this court.

Learned counsel appearing for the petitioners submits that the petitioners have been provided the privilege of anticipatory bail, however, they have not appeared before the learned court within the stipulated time, as the petitioners were working as labourer in the other State and they earn their livelihood from that work. He submits that further due to illness they have not got the fruit of the said order. He next submits that two weeks’ time may kindly be allowed to the petitioners to surrender before the learned court.

Learned A.P.P. appearing for the State submits that in spite of the privilege of anticipatory bail, provided to the petitioners, the petitioners have not surrendered before the learned court.

There is no doubt that there is delay in filing of the present petition, however, it transpires that the case is arising out of the complaint case and petitioners and the complainant are said to be

gotiyas and further the petitioners were doing labour work in the other State ,in that view of the matter, further two weeks’ time from today is extended to the petitioners to surrender before the learned court.

The order dated 26.06.2018, passed in A.B.A. No. 7160 of 2017 by this court is modified to the above extent and the rest of the conditions are kept intact.

With the above observation, this petition is disposed of.
