1. Mr. Tapan Singh, learned counsel for the petitioners in WPMS No. 08 of 2026.

4. Both the petitions pertains to a land falls in Village Ibrahimpur, Masahi, Tehsil Roorkee, District Haridwar and with the consent of the learned counsel for the parties both the petitions are being decided together.
5. In WPMS No. 8 of 2016, following relief has been sought:-
(i) Issue a writ order or direction in the
nature of mandamus commanding/
directing to the Consolidation Officer (Third)
Roorkee to decide the case no. 723 of 2025,
Prashant and others vs. State U/s 9A(2) of
U.P. Consolidation of Holding Act
expeditiously as soon as possible, within the
stipulated period fixed by this Hon’ble
Court.
So far as WPMS No. 672 of 2025, is concerned, following relief has been sought:
(i) Issue a writ or order in the nature of
mandamus directing respondent nos. 1 and
2 to issue directions and to remove the
illegal encroachment from Chak Road
situated in Gata No. 1628/1, 128/3,
1626/1, 1626/2 in Chak No. 759, Revenue
Village Ibrahimpur Masahi, Tehsil
Bhagwanpur District Haridwar forthwith.
6. In WPMS No. 8 of 2016, the petitioner is praying for a direction that Consolidation Officer (III) Roorkee be
directed to decide Case No. 723 of 2025, Prashant and others vs. State as expeditiously as possible wherein the petitioners have filed application U/s 9A(2) of U.P. Consolidation of Holding Act. So far as WPMS No. 672 of 2025 is concerned, the petitioners are praying for removal of illegal encroachment from Chak Road situated in Gata No. 1628/1, 128/3, 1626/1, 1626/2 in Chak No. 759 Revenue Village Ibrahimpur Masahi, Tehsil Bhagwanpur, District Haridwar.
7. Without going into the merit of both the petitions, this Court is of the view that since, the petitioners of WPMS No. 8 of 2026 already moved an application under Section 9A(2) of the U.P. Consolidation of Holding Act, which is still pending for
consideration, the Authority should decide the same as per law as early as possible.

In such view of the matter, both the petitions are disposed of finally with the direction to the Consolidation Officer (III) Roorkee, District Haridwar to decide the Case No. 723 of 2025, preferred under Section 9A(2) of U.P. Consolidation of Holding Act within a period of three weeks from the date of production of certified copy of this order. It is made clear that while deciding the matter, the petitioners of WPMS No. 672 of 2025 be also given opportunity of hearing. It is further made clear that while deciding the matter, the Consolidation Officer (III) Roorkee, shall pass a reasoned and speaking order
after giving full opportunity of hearing to the petitioners of both the petitions.
