1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-
“(i) to issue necessary writ, order, directions to quash the Refusal
Order No. F-SR-11(A)/PB/Refusal/Book II/2025/380 dated 30.05.2025 issued by the Respondent No.2, being contrary to Section 17 of the Registration Act, 1908 and amounts to violation of Petitioner's rights under Article 300-A of the Constitution of India; (ii) to direct the Respondent No.2 to register the Lease Deed dated 16.05.2025 for the Commercial Premises / Shop / Unit No.GF/28 This is a digitally signed order. (approx. 2,225 sq. ft.) at Commercial Complex known as Emaya Mall (formerly known as “Capitol City Mall”) situated at Plot No.1, between Block No. BG-1 and BG-2, Paschim Puri, New Delhi-110063, in accordance with Section 17 of the Registration Act, 1908;”
2. For the reasons stated in the petition, issue notice.
3. Ms. Singh, learned panel counsel accepts notice on behalf of the respondent No. 2.
4. In view of the stay order dated 19.05.2023 passed in W.P.(C) 6868/2023 prima facie there seems to be no impropriety in respondent No. 2 not registering the lease deed dated 16.05.2025 vis a vis the petitioner’s property.
5. Mr. Maittri, learned counsel for the petitioner, states that in this view of the matter he will lease out the subject property through an unregistered document.
6. The Court is not required to comment or adjudicate upon the statement of Mr. Maittri, learned counsel for the petitioner.
7. In this view of the matter, the present petition is disposed of, along with pending application(s), if any.
