Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. The only material available against the petitioner is the statement of the co-accused. 3. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He submits that other than the statement of the co-accused, there are two criminal antecedents of the petitioner apart from the present case, one of which is under the provisions of the NDPS Act where a charge sheet has been submitted. 4. Considering the above, the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case to grant anticipatory bail to the petitioner. 2 5.
