HC-KAR NC: 2026:KHC:2056 CRL.P No. 4568 of 2023
CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA
ORAL ORDER
The petitioners are before this Court calling in question the proceedings in C.C.No.1640/2018 registered for offences punishable under Sections 417, 420, 504, 506, 34 and 35 of the Indian Penal Code.
2. Heard Sri.Girish B.Baladare,
learned counsel appearing for the petitioners, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri.Santhosh H.R., learned counsel appearing for respondent No.2 and have perused the material on record.
3.
Facts in brief, germane, are as follows:
3.1. The petitioners are the purchasers of pepper from the hands of the complainant on the score that the petitioners declined to fulfil the amount of purchase of pepper and kept in due close to Rs.7,00,000/-. It is alleged that the complainant goes to the doors of the petitioners at which point in time he

was abused and also threatened for his life. Based upon this, a complaint comes to be registered by the complainant on
30.04.2018. Contemporaneously, the complainant also institutes a civil suit for recovery of money in O.S.No.106/2018. The claim of the petitioners in the said suit is as follows: <9. The Reliefs:
(a) Amount due as per settlement dt: 11.6.2017. Rs.6,15,872-00 (b) Interest at 14% from 11.6.2017 to date on Rs.6,15,872/-
Rs.1,07,776-00
(c) Notice charges:
Rs. 2,500-00
Rs. 7,26,148-00
10. Wherefore the plaintiff prays for a judgement and decree in his favour and against the defendants for a sum of Rs.7,26,148/- with current interest @ 14% per annum from date of suit till realization and with Court costs and such other reliefs as this Hon'ble Court deems fit to grant.=
3.2 It transpires that O.S.No.106/2018 is decreed for Rs.7,26,148/- to be paid by the petitioners to the complainant. The said judgement and decree is challenged by the accused before the First Appellate Court in R.A.No.14/2025. The issue now would be in the teeth of the decree obtained by the complainant on the same cause of action, could have set the criminal law in to motion for offences punishable under Sections 417, 420, 504 and 506 of the Indian Penal Code. - 5 -

4. A perusal at the complaint would indicate it is inter alia on the demand of money. Therefore, sections 417 and 420 of IPC which is sought to be alleged against the petitioners could not have been alleged in the teeth of the complainant instituting a civil suit and civil suit ending up in a decree in favour of the complainant. What remains is the offence under Sections 504 and 506 of the IPC. The complaint dated 30.04.2018 so registered by the complainant against the petitioners reads as follows: <Î ÝÝ ¼ Î ®ÆÝ¼Í ÝÝ ¾Î, ®ÆݼÍ. ® Î ÎÎÝ ! ÎÎÝ, 58 yrs .

5. The reason for registering the complaint is two fold. One money is not returned, the other he has been assaulted at the time when he demanded money. As observed hereinabove, what remains is offences under Sections 504 and 506 of IPC. For offences punishable under Sections 504 and 506 of IPC, the ingredients as obtaining in Section 503 of IPC are necessarily found. Therefore, the proceedings must continue for offences under Sections 504 and 506 of the IPC while it cannot be permitted to be continued qua offences under Sections 417 and 420 of the IPC. 6. For the aforesaid reasons, the following:
