Corresponding to Section 483 of the B.N.S.S in connection with Naihati Police Station Case No.59 of 2024 dated 24-02-2024 under Sections 326/506/201/120B/34 of the I.P.Cadding section 302IPC . P.P., Ms. Mayukhi Mitra, Mr. Bankim Pal, ..…For the State 1. The present application has been filed by the petitioner praying for bail mostly on the ground of parity since the other co-accused are already enlarged on bail. 2. In this regard, the order passed by the co-ordinate Bench is relied upon. 3. On behalf of the prosecution objection has been raised and submits that there is dying declaration in respect of the deceased where involvement of the petitioners are apparent who are the ja and sister in law of the victim. 4. Having heard both the learned counsel and going through the materials on record as well as case diary and the statement recorded under Section 32(1) and Section 33 of the Evidence Act, it appears that present petitioners are not principle accused persons and the husband /principle accused person is in custody. 5. The present petitioners are in custody since December 2024 and both of them are ladies aged about 47 and 55 years respectively. The co-accused similarly situated with these two petitioners were granted bail only on the ground of long incarceration and no progress in the trial. After such order also trial has not progressed satisfactorily . 6. Hence on the ground of parity with the co-accused as well as delay in proceeding with the trial the prayer of the petitioners stands allowed. 7. Accordingly the petitioners, namely, Laxmi Pal @ Laxmi Paul and Basanti Pal @Basanti Paul shall be released on bail upon furnishing a bond of Rs.10,000/- (Ten Thousand Only), with two sureties of like amount each, one of whom must be local, to the satisfaction of learned ACJM, Barrackpore subject to the following condition : a) The petitioners shall not intimidate the witnesses and/or temper with evidence, in any manner whatsoever and shall not commit any cognizable offence in any manner whatsoever. 2 b) The petitioners shall appear before the Learned trial court on every date or as and when required to be present until further orders. c) In the event, the petitioners failed to comply with any of the condition stipulated above, the trial Court shall be at liberty to cancel the bail in accordance with law without further reference to this Court. 6. The application for bail is, thus, allowed. 7. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. 8. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. (CHAITALI CHATTERJEE (DAS), J.) 3
