Plaintiff petitioner had filed a suit for eviction of the defendants from the property in dispute. In the said suit an application under Order VII Rule 11 CPC was moved by the defendants which was dismissed, against which a civil revision was preferred, which was partly allowed and matter has been remitted back to the trial court to decide the application under Order VII Rule 11 CPC afresh. 2. I have heard learned counsel for petitioner and perused the material on record. No case for interference is made out. 3. Writ petition is dismissed, accordingly. 4. Trial court to proceed with the matter, post remand, and decide the application under Order VII Rule 11 CPC, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of receipt of a certified copy of this order.
