For Petitioner : Mr.M.Jerin Mathew For Respondents : Mrs.K.R.Shiva Shankari Counsel for State 1/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.18952 of 2026 ORDER This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the second respondent to act upon the proceedings of the first respondent dated 15.02.2026 and consequently refund a sum of Rs.47,050/- to the petitioner, together with applicable interest, within such time as may be stipulated by this Court. 2.By consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal at the stage of admission itself. 3.The learned counsel appearing for the petitioner submitted that the petitioner participated in a public tender and applied for nine jobs, for which he deposited a sum of Rs.47,050/- towards Earnest Money Deposit (EMD). However, the jobs were not allotted to the petitioner. Despite the same, the Earnest Money Deposit has not been refunded to the petitioner till date. Therefore, the petitioner caused a legal notice to be issued on 2/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.18952 of 2026 29.01.2026. Pursuant thereto, the first respondent/Block Development Officer, by proceedings dated 15.02.2026, directed the Village Secretary to refund the said amount to the petitioner. However, the said direction has not been implemented till date. Aggrieved by the inaction on the part of the respondents, the present Writ Petition has been filed. 4.Considering the above facts and circumstances, the first respondent is directed to ensure the implementation of his own proceedings dated 15.02.2026 and effect the refund of the Earnest Money Deposit amount to the petitioner within a period of six (6) weeks from the date of receipt of a copy of this order. 5.With the above direction, this Writ Petition stands disposed of.
