ORAL JUDGMENT IN MFA No. 2246/2015 This appeal is filed by the appellant/claimant under Section 173(1) of Motor Vehicles Act, 1988 challenging the
judgment and award dated 27.12.2014 passed in MVC No.2988/2013 on the file of the XII Additional Small Causes Judge, Member, MACT, Bengaluru, for enhancing the compensation. 2. Heard the arguments of the learned counsel for the appellant. Learned counsel for respondent remained absent previous day and also today. Therefore, matter is taken up for final disposal. The ranks of the parties are retained as per tribunal for the sake of convenience. 3. The injured claimant met with an accident on 20.01.2013 and filed claim petition claiming compensation of Rs.15,00,000/-. The Tribunal considered the entire evidence on record and granted an amount of

Rs.1,37,283/- along with the interest at the rate of 6% p.a., from the date of petition till the date of realisation. 4. Aggrieved by the said award, she preferred an appeal and mainly contended
that she spent Rs.2,00,000/- towards medical expenses. She was inpatient from 21.01.2013 to 25.01.2013. The Tribunal granted inadequate compensation. Though she was earning Rs.30,000/- per month, the amount granted under the other heads is meager. The doctor assessed her disability as 12.66%, but the tribunal has taken it as only 8% and thus requested for enhancement of the compensation. 5. The Petitioner was a housewife and she has not filed any income proof. As she met with an accident in the year 2013, this Court finds it reasonable to take her notional income as Rs.8,000/- per month as per the chart prepared by Karnataka State Legal Services Authority. She was aged 36 years and the multiplier taken is 15. Ex.P4/wound certificate issued by the B.G.S. Global

hospital, in which it is clear that the petitioner has sustained the following injuries; 1)Undisplaced fracture of right ulna 2)Blunt injury on chest which are grievous in nature. The Petitioner also examined doctor as PW2 and he stated that she sustained displaced middle, third, right ulna and blunt injury on the chest and assessed the disability as 33% to the upper limb and 12.66% to the whole body, 1/3rd of 33% comes to 11%. The Tribunal observed that she has not undergone any surgery at the time of discharge.
Her condition was stable and she is using her right hand and thus taken her disability as 8% instead of 12.66%. This Court finds it reasonable to take 1/3rd of 33% i.e., 11%., instead of 8%. The loss of future earning capacity comes to Rs.8,000 X 12 X 15 X 11% = Rs.1,58,400/-. The Petitioner was hospitalized for a period of 6 days. Considering her nature of injuries, period of hospitalization, this Court finds it

reasonable to enhance the pain and suffering to Rs.50,000/-. Loss of amenities to Rs.25,000/- . She might not have attended any other work at least for a period of 3 months, therefore, she is entitled for Rs.24,000/- under the head loss of income during laid- up. She is also entitled for Rs.30,000/- under the head transportation, extra nourishment and attendant charges. The Tribunal granted Rs.5,283/- towards medical expenses and it is confirmed. 6. Tribunal erroneously considered the disability as 9% and granted Rs.1,00,000/- and the same requires to be set aside. He was hospitalized for a period of 6 days.
PW2 suggested that he requires total hip replacement for AVN of left head of left femur and its estimated cost is Rs. 3.2 lakhs. Further, PW2 in the cross examination stated that there is no compulsion for replacement of the AVN of left head of the left femur. As such, no amount was granted towards future medical expenses. His mother might have taken care of him at least for a period of 3 months, as he sustained grievous injuries in the accident.
