O.P.(MD) No.12830 of 2026, For petitioner : M/s.P.Hasnah For R1 : Mr.G.Ganesh Kumar Government Advocate (Crl.Side) ORDER The present petition has been filed by the sole accused in S.C.No.139 of 2026, on the file of the Hon'ble Principal District and Sessions Judge, Tenkasi, seeking to quash the charge sheet, wherein the petitioner has been charge sheeted for the offence punishable under Sections 74, 75(2), 296(b) and 351(3) of BNS. 2. A perusal of the charge sheet reveals that the petitioner is said to have done absinthe acts and physically abused the defacto complainant herein. 3. According to the learned counsel appearing for the petitioner there is a civil dispute pending between the petitioner and the defacto complainant's father and therefore, a false complaint has been filed. 2/4 https://www.mhc.tn.gov.in/judis Crl. A perusal of the memo of evidence filed on the side of the prosecution reveals that the CCTV footage, in the form of a CD, has been produced before the Court in relation to the alleged incident. The materials available on record, including the charge sheet, disclose a prima facie case against the petitioner. Hence, there is no reason to quash the entire proceedings pertaining to the case in S.C.No.139 of 2026, on the file of the learned Principal District and Sessions Judge, Tenkasi. 6. In view of the above, this Court finds no merits in the petition. Accordingly, the Criminal Original Petition stands dismissed. No costs.
