No.18329 of 2026 ORDER This writ petition has been filed to issue a writ of certiorarified mandamus to quash the order passed by the first respondent in his proceedings in Na.Ka.No.1301/A1/2024 dated 01.07.2024 insofar as denial of approval from 05.10.2017 to 19.04.2023 and for consequential direction to the respondents to approve the appointment of the petitioner as Secondary Grade Teacher from the date of appointment i.e., from 05.10.2017 with salary and all other consequential benefits. 2. When the matter is taken up for consideration, the learned counsel for the petitioner placed reliance on an order passed by this Court dated 08.06.2026 in WP(MD)No.5789 of 2026 and batch and contended that the issue that arises for consideration in this writ petition also is identical to the issue that was decided by this Court in the order dated 08.06.2026 and further contended that the impugned order cannot be sustained and the petitioner is entitled for approval of appointment from the date of initial appointment that is 05.10. 2017. 3.Mr.M.Dinesh Hari Sudarsan, learned Counsel for Government, 2/5 https://www.mhc.tn.gov.in/judis WP(MD). No.18329 of 2026 having perused the said order dated 08.06.2026, fairly submitted that the very same issue has been dealt with by this Court and the present issue that arises for consideration is covered by the said order dated 08.06.2026. 4. In the circumstances, this Court does not see any reason to hear the matter on merits once again and there is no dispute about the factual aspects, especially, with regard to the actual date of appointment of the petitioner being 05.10.2017 and the decision of the Hon'ble Division Bench of this Court in Irudhaya Amali's case is held to be having only prospective effect and there was no mechanism to ascertain the surplus staff prior to 31.03.2021 and the petitioner was originally appointed prior to 31.03.2021. This Court is also thoroughly convinced that the issue is squarely covered by the earlier order dated 08.06.2026 passed by this Court. 5. In the light of the above, the impugned order is liable to be quashed to the extent of not granting approval from the date of actual appointment that is 05.10.2017 and accordingly, the same is quashed to 3/5 https://www.mhc.tn.gov.in/judis WP(MD). No.18329 of 2026 the above extent and the first respondent is directed to issue consequential proceeding approving the appointment to the petitioner as Secondary Grade Teacher with effect from the actual date of appointment as expeditiously as possible, at any rate, within a period of eight weeks from the date of receipt of a copy of this order and release all consequential benefits. 6.
