It is submitted that their marriage was performed in the year 2019 and the distance between Nelamangala and Bangalore is 29 kms., and it is a very short distance. - 3 - HC-KAR NC: 2026:KHC:5407 CP No. 141 of 2025 4. Learned counsel for the respondent submitted that his father recently passed away who was aged 65 years and that his mother is residing along with him and he has to take care of her. Further submits that the Tribunal also granted visitation rights for twice in a month in an order dated 27.02.2025. But his wife is not permitting him to visit the child and that she is also not complying the order of the court. He also stated that there was some quarrel between petitioner and her relatives and himself in the court premises at Bangalore. The matter is coming up for cross-examination of PW1. Admittedly, the distance between both the places is only 29 kilometres, which is negligible, therefore, submits that the parties should not abuse the process of law. 5. The present petitioner/wife filed this case for the transfer of the case in MC.No.113/2024 from the file of Bangalore to Nelamangala which is at a distance of 29 kilometers. She stated that respondent is resident of Bangalore and is highly influential person and there is - 4 - HC-KAR NC: 2026:KHC:5407 CP No. 141 of 2025 threat to her life and also submits that she has to travel from Nelamangala to Bangalore with constant fear. Even respondent counsel stated that there was a quarrel in Bangalore court. 6. Therefore this court finds it is just and reasonable to transfer MC No.113/2024 from the file of Family Court of Principal Family Court, Bangalore to Senior Civil Judge, Nelamangala, for fair trial. In the result, this petition is allowed. MC No.113/2024 is transferred from the file of Family Court of Principal Family Court, Bangalore to Senior Civil Judge, Nelamangala.
