GP FOR SERVICES I The Court made the following: 4 THE HONOURABLE SRI JUSTICE D RAMESH THE HONOURABLE SRI JUSTICE B V L N CHAKRAVARTHI WRIT APPEAL NO: 748 OF 2026 JUDGMENT: (Per Hon’ble Sri Justice D.Ramesh) The present writ appeal is filed aggrieved by the docket order dated 23.06.2026 passed in W.P.No.15445 of 2026. 2. The said docket reads as under: “In this case, as the transfer is already effected by the Administrative Department of the Respondent- University, it would not be appropriate to this Court to pass any interim order without hearing the Respondents’ counsel”. 3. The aforesaid writ petition is filed assailing the proceedings dated 29.05.2026 of the 1st respondent/university, whereby the appellant who is working as Professor (CAS), was transferred from the Department of Veterinary Biochemistry, NTR College of Veterinary Science, Gannavaram, to the Department of Veterinary Physiology & Biochemistry, College of Veterinary Science, Garividi. 4. The primary contention of the appellant is that one Dr.K.Padmaja, Professor (CAS), Department of Veterinary Physiology & Biochemistry, College of Veterinary Science, Garividi has made a request to transfer her services to the 5 College of Veterinary Science, Tirupati, as she is going to retire on 30.06.2026, and in the resultant vacancy, the respondents have considered and transferred the appellant, which is quite contrary to the transfer guidelines. 5. It is contended that the appellant’s services are very much required to continue in the present place as he is in-charge of a prestigious project which is run by Bill Gates foundation. Apart from that, the learned counsel for the appellant has also placed reliance on the averments made in the affidavit with regard to the faculty strength of the said institution. 6. It is further contended that before the transfer, the faculty strength of the institution at Gannavaram was three, consisting of one Professor and two Assistant Professors, whereas the faculty strength at Garividi was four, i.e., one Professor, one Associate Professor, and two Assistant Professors. If the appellant is transferred from Gannavaram, the faculty strength at Gannavaram would be reduced to only two Assistant Professors, which is contrary to the guidelines issued by the Veterinary Council of India. 7. Above all, the learned counsel for the appellant has laid stress that the rejection of the interim orders passed by the learned Single Judge is only on the ground that the transfer has 6 already been effected by the administrative department of the respondent/University. However, though the learned Single Judge refused to pass the interim orders, the fact remains that, even as on today, the appellant is continuing at the same place. To support her contention, she has also placed before us the Attendance Register. 8. Replying to the above, the learned Standing Counsel for the University has submitted that in fact, earlier Division Bench of this Court had considered the issue with regard to the transfer of teaching staff and stayed the orders passed by the learned Single Judge. The said orders were confirmed by the co-ordinate Bench holding that constituent colleges have been considered to be a single unit. Further, he has also placed reliance on the instructions furnished by the University. According to the said instructions, as the appellant is the only Professor available in the concerned discipline, and for better administration, his services are very much required at Garividi and the transfer was made only for larger academic and administrative interest of the University. 9. Considering the above said instructions and also the observation made by the co-ordinate Bench in W.A.No.305 of 2023, this Court is not inclined to interfere at this stage and more 7 particularly when the writ petition is still pending. Accordingly, as requested by the learned counsel for the appellant and learned Standing Counsel for the University, the Writ Appeal is disposed of granting liberty to the Standing Counsel to file counter-affidavit before the learned Single Judge within a period of two (02) weeks from today with regard to the factual aspects raised by the appellant in the affidavit. After filing the counter-affidavit, the matter may be disposed of on merits. As urgency is expressed by the learned counsel for the appellant, learned Single Judge is requested to dispose of the matter as expeditiously as possible. 10. Accordingly, the Writ Appeal is disposed of. There shall be no order as to costs.
