For Petitioner : Mr.K.Yasar Arafath For Respondents : Mr.M.Mahaboob Athiff (R1 to R4) ORDER This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing respondents 1 to 4 to remove the garbage dumped in the vacant land comprised in Survey No.288/2B, situated at Vilathur Village, Paramakudi Taluk, Ramanathapuram District, and consequently restrain the fifth respondent, his men, agents or anyone claiming through him from dumping garbage in the said land in future, by considering the petitioner's representation dated 15.06.2026, within a time frame to be fixed by this Court. 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.18942 of 2026 2.By consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal at the stage of admission itself. 3.Since no adverse order is proposed to be passed against the fifth respondent, notice to the fifth respondent is dispensed with. 4.The learned counsel appearing for the petitioner submitted that the petitioner submitted a detailed representation dated 15.06.2026 before the competent authorities requesting them to remove the garbage dumped in the aforesaid vacant land and to take appropriate steps to prevent any further dumping of garbage in the said property. Despite receipt of the said representation, no orders have been passed by the authorities concerned. Aggrieved by such inaction on the part of the respondents, the petitioner has filed the present Writ Petition. 5.The learned counsel for the petitioner further submitted that the petitioner would be satisfied if this Court issues a direction to the 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.18942 of 2026 competent authority to consider the petitioner's representation dated 15.06.2026 and pass appropriate orders thereon within a time frame to be fixed by this Court. 6.Considering the facts and circumstances of the case, and without expressing any opinion on the merits of the petitioner's claim, this Writ Petition is disposed of with a direction to the competent authority to consider the petitioner's representation dated 15.06.2026, after affording an adequate opportunity of hearing to the petitioner, the fifth respondent and any other interested or affected parties, if any, and thereafter pass appropriate orders on merits and in accordance with law. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order.
