RAGHAVENDRA, AGA FOR R-1 & SRI RAKSHITH KUMAR, ADVOCATE FOR ACCUSED No.2) THIS CCC IS FILED UNDER SECTIONS 11 AND 12 OF THE CONTEMPT OF COURTS ACT, PRAYING TO SECURE THE PRESENCE OF THE ACCUSED AND PUNISH THE ACCUSED FOR COMMITTING CONTEMPT OF COURT AND FOR WILLFUL DISOBEDIENCE OF THE INTERIM ORDER PASSED BY THIS HON'BLE COURT IN W.P.NO.6056/2025 DATED 28/02/2025 & ETC. THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MR. JUSTICE C.M. POONACHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging wilful disobedience of the order dated 28.02.2025 passed by the learned Single Judge of this Court in W.P.No.6056/2025 (GM-KSR). - 3 - HC-KAR NC: 2026:KHC:12969-DB CCC No. 545 of 2025 2. In terms of the said order, the learned Single Judge had directed the accused to furnish all requisite information to the complainant in terms of the application which was annexed as Annexure-B to the writ petition. The Court had further directed that till the next date of hearing the proceedings shall be stayed. 3. An affidavit of compliance has been filed wherein it is affirmed that the documents sought for have been provided. 4. The learned counsel appearing for the complainant does not dispute the same. He, however, submits that the same has been provided belatedly and despite the stay order, the accused had continued the proceedings and passed an order on 28.02.2025. He further submits that the same violates the order passed by the learned Single Judge. 5. A plain reading of the order dated 28.02.2025 passed by the accused indicates that it had passed an order prior to receiving the information regarding the stay order passed by this Court in W.P.No.6056/2025. However, after becoming aware of the same, the accused had kept the order passed on that day in abeyance. - 4 - HC-KAR NC: 2026:KHC:12969-DB CCC No. 545 of 2025 6. In view of the above, we are unable to accept that any proceedings for wilful disobedience of the order passed by this Court under the Contempt of Courts Act, 1971 is warranted. 7. The complaint is accordingly closed. Sd/- (VIBHU BAKHRU) CHIEF JUSTICE Sd/- (C.M. POONACHA) JUDGE KPS List No.: 1 Sl.No.18.1
