No.470 of 2023 arising out of Gidhour P.S. Case No. 54 of 2023 for the offence registered under Section 302 of the IPC pending in the Court of learned District & Additional Sessions Judge-I, Chatra, is pressed into motion. As per the prosecution case, the deceased was the wife of this petitioner and they had gone into forest area for collecting Mushroom and later her dead body was found. On the disclosure statement made by this petitioner, weapon of offence was recovered which was sent to FSL and blood stained Tangi matched with that of the deceased. It is submitted by the learned counsel on behalf of petitioner that there is no eye witness to the incidence and the chain of circumstances is not complete to prove the charge against the present petitioner. More than two years have elapsed since the custody of the accused, but the trial has not been concluded. Learned A.P.P. opposed the bail petition. Under the circumstances, considering the nature of allegation and the materials on record, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner, is hereby, rejected. Learned trial Court is however directed take steps for expeditious disposal of this case. (Gautam Kumar Choudhary, J.)
