Ramalingam For R1 & R2 : Ms.K.R.Shivashankari, Counsel for State For R3 : Mr.R.Mohamed Riyaz Government Advocate (Criminal Side) O R D E R This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the third respondent to initiate appropriate action, based on the proceedings of the first and second respondents dated 10.04.2024 and 02.07.2024, respectively, for recovery of the monthly maintenance amount together with the arrears from the fourth respondent, in terms of the order passed by the second respondent dated 29.04.2023 under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, within a time frame to be fixed by this Court. 2. Heard the learned counsel for the parties. 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. The learned counsel appearing for the petitioner would submit that the petitioner is the mother-in-law of the fourth respondent. The petitioner's son, who was the husband of the fourth respondent, passed away and thereafter, the fourth respondent neglected and refused to maintain the petitioner. Consequently, the petitioner invoked the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 by filing an application before the second respondent. By order dated 29.04.2023, the second respondent directed the fourth respondent to pay a sum of Rs.10,000/- per month towards maintenance to the petitioner. 5.The learned counsel would further submit that since the fourth respondent failed to comply with the said order, the petitioner submitted a representation before the first respondent seeking implementation of the maintenance order. Pursuant thereto, the first respondent, by proceedings dated 10.04.2024, directed the second respondent to recover the maintenance amount from the fourth respondent. It is the grievance of the petitioner that despite the 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.19064 of 2026 said direction, no effective steps have been taken by the second respondent to recover the maintenance amount. Hence, the present writ petition. 6. Having considered the submissions made by the learned counsel appearing for the petitioner and in view of the limited prayer sought for, without expressing any opinion on the merits of the claim, this writ petition stands disposed of with a direction to the respondents 2 and 3 to implement the order dated 29.04.2023 and the consequential proceedings of the first respondent dated 10.04.2024, if the same continue to remain in force and there is no legal impediment, by initiating appropriate recovery proceedings in accordance with law, after affording an opportunity to the fourth respondent. Such exercise shall be completed as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order.
