GURUVA REDDY N, ADVOCATE; SRI. JUSTICE R DEVDAS ORAL ORDER Learned High Court Government Pleader takes notice for respondent Nos.1 to 3. Notice to respondent Nos.4 to 18 is not necessary for the following reasons. 2. The grievance of the petitioner is that although in a family partition, the petition schedule property fell to the share of the petitioner and his name was entered in the RTC, nevertheless, one of the brothers of the petitioner has sold the - 5 - HC-KAR NC: 2026:KHC:3036 WP No. 10974 of 2024 property although it does not belong to him. Pursuant to the said sale transaction, the name of the petitioner has been removed from the RTC while entering the name of the purchaser. 3. In the considered opinion of this Court, when disputed questions of title arise, the revenue authorities are not permitted to enter into such arena. That is the law laid down by the full bench of this Court in the case of Smt.Jayamma and Others Vs. State of Karnataka and Others reported in ILR 2020 KAR 1449. Moreover, it appears that the petitioner has already instituted a suit seeking declaration of title. The Revenue Department of the State Government has also issued a circular recently directing that wherever orders are passed by the Civil Court in respect of revenue lands, such orders shall be entered in Column No.11 to protect the interest of the parties so that there will be no multiplicity of proceedings or further sale transactions during pendency of the suit. Such being the position, it is always open for the petitioner to get an order at the hands of the Civil Court and have it entered in Column No.11 to protect the interest of the petitioner. Accordingly, the writ petition stands disposed of. - 6 - HC-KAR NC: 2026:KHC:3036 WP No. 10974 of 2024 Learned High Court Government Pleader is permitted to file memo of appearance within a period of two weeks from today.
