The petitioner is aggrieved that an opportunity of progression under the Career Advancement Scheme for the post of Assistant Professor has not been considered by the concerned authority, respondent no. 2 herein. In fact, the order of September 29, 2023, which is assailed in the present writ petition, was passed without considering the documents and without giving an opportunity of hearing to the petitioner. 2. Pursuant to the direction of this Court on January 5, 2026, Mr. Das, learned Advocate appearing for the State, has taken instructions in this matter. He submits, on instructions, that the 2 petitioner was indeed not given an opportunity of hearing before passing of this order. In fact, the order was made on the basis of the documents forwarded by the College Authorities, as specified herein. 3. Mr. Basu, learned Advocate appearing for the College Authorities, submits that all requisite documents had been forwarded by the College Authorities to the respondent no. 2 within a reasonable period of time. 4. The order has been passed without giving an opportunity of hearing and multiple issues have been raised by the petitioner that the fixation of pay scale and the promotion of the petitioner, not only to the rank of the Assistant Professor but also to the rank of the Professor, have not been duly considered. 5. In the circumstances, as aforestated, the order of September 29, 2023, is set aside. 6. Respondent no. 2 is directed to form a Screening Committee who will go through the requisite papers and documents available to the College Authorities in so far as the petitioner’s grievances are concerned, by January 20, 2026. 7. Screening Committee will conduct its meeting as expeditiously as possible and intimate the respondent no. 2 of its decision within a period of 3 three weeks from the date of formation of the Screening Committee. 8. Respondent no. 2 will, thereafter, consider the decision of the Screening Committee, upon giving adequate opportunity of hearing to the College Authorities as well as the petitioner, within a period of two weeks thereafter. 9. The entire process, as aforestated, will be completed by March 15, 2026. 10.With the aforestated directions, the writ petition is disposed of. 11. There shall, however, be no order as to costs. 12. Since no affidavit has been called for, the allegations contained in the writ petition are deemed to be denied. 13.Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
