CRL OP(MD). No.12901 of 2026 PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- C-38AB. For Anticipatory Bail in Crime No. 186 /2026 on the file of the respondent Police.
ORDER : The Court made the following order :-
The petitioner, who apprehends arrest at the hands of the respondent police for the offences under Sections 115(2), 296(b), 118(1) and 351(3) of BNS, 2023, in Crime No.186 of 2026, on the file of the respondent Police, seeks anticipatory bail.
2. The allegation against the petitioner is that due to previous enmity between the defacto complainant's group and the petitioner's group, there was quarrel between them and that the petitioner and his group abused and assaulted the defacto complainant and his group and thereby, caused injuries to them. Hence, the present complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and he is no way connected with the alleged 2/6 https://www.mhc.tn.gov.in/judis
CRL OP(MD). No.12901 of 2026 offence as stated by the defacto complainant and that he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for the respondent police while opposing for granting anticipatory bail to the petitioner, reiterated the prosecution case and submitted that the injured has been discharged from the hospital and that there is a Counter Case No.185 of 2026, is registered.
5. Heard the learned counsels and perused the materials available on record.
6. Considering the facts of the case and the injured in this case was already discharged from the hospital and there is a case in counter, this Court is inclined to grant anticipatory bail to the petitioner subject to certain conditions. 3/6 https://www.mhc.tn.gov.in/judis
CRL OP(MD). No.12901 of 2026 [a] Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date on which the
order copy made ready, before the learned Judicial Magistrate, Sankarankovil on condition that the petitioner shall execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate concerned and on further conditions that: [b] the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter, as and when required for interrogation. [c] the petitioner shall not commit any offences of similar nature. [d] the petitioner shall not abscond either during investigation or trial. CRL OP(MD). No.12901 of 2026 learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
