For Petitioner : Mr. B.Mohamed Kasim For R-1 and R-2 : Mr. M.Sivanupandian, Standing Counsel O R D E R This Writ Petition has been filed seeking declaration declaring that the petitioner in respect of Shop No.102, situated in the New Bus Stand, Tirunelveli is entitled to pay lease rental at the rate of Rs.140/- (Rupees One Hundred and Forty only) per square feet per month in terms of the directions issued by the Hon'ble Supreme Court in SLP(C).Nos.27248-27249 of 2023 dated 13.12.2023 and consequently declare that any demand made by the respondents for payment of rent at any rate higher than Rs.140/- per square feet is illegal, arbitrary, discriminatory and enforceable. 2. Heard Mr. B.Mohamed Kasim, learned counsel appearing for the petitioner, and Mr. M.Sivanupandian, learned Standing Counsel, who takes notice on behalf of the first and second respondents. 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.18777 of 2026 3. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 4. The learned counsel appearing for the petitioner submitted that the petitioner is the lessee of Shop No.102 situated at the New Bus Stand, Tirunelveli. According to the learned counsel, the issue relating to fixation of lease rent for the shops situated in the New Bus Stand, Tirunelveli, had already been considered by the Hon'ble Supreme Court in SLP (C) Nos.27248-27249 of 2023, by order dated 13.12.2023, wherein it was directed that the lease rent shall be fixed at Rs.140/- per square feet per month. However, the respondents have demanded lease rent at a higher rate. Challenging the said demand, the present Writ Petition has been filed. 5. Per contra, the learned Standing Counsel appearing for the respondents fairly submitted that the petitioner is also similarly placed and that the benefit of the order passed by the Hon'ble Supreme Court would be extended to the petitioner as well. He further submitted that the respondents would revise the 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.18777 of 2026 demand by fixing the lease rent at Rs.140/- per square feet per month, in terms of the directions issued by the Hon'ble Supreme Court. 6. In view of the above submission made by the learned Standing Counsel appearing for the respondents, no further adjudication is required. The respondents are directed to extend the benefit of the order passed by the Hon'ble Supreme Court in SLP (C) Nos.27248-27249 of 2023 dated 13.12.2023 to the petitioner and revise the lease rent payable by the petitioner by fixing the same at Rs.140/- (Rupees One Hundred and Forty only) per square feet per month, if not already done, within a period of one week from the date of receipt of a copy of this order. 7. With the above direction, this Writ Petition stands disposed of.
