For Petitioner : Mr.A.Sivanu Pandian For Respondents : Mr.Y.Jagadeesh, for R-2 to R-4 Mr.R.Ramasamy, Counsel for the State for R-1 and R-5 2/8 https://www.mhc.tn.gov.in/judis W.P(MD)No.18520 of 2026 ORDER This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing respondent Nos.3 to 5 to implement Rule 8(c) of the Tamil Nadu Regularization of Unapproved Plots of Layout Rules, 2017 by giving effect to the proceedings of the second respondent dated 01.08.2018, 21.08.2018, 19.09.2018, 20.12.2018, 10.09.2019 and 09.12.2019 in Na.Ka.No.4660/2018/MCF1; dated 15.02.2021 in Na.Ka.No. 9810/2020/MCF1; dated 21.10.2021 in Na.Ka.No.11187/2020/MCF1; dated 31.10.2022 in Na.Ka.No.1745/2022/MCF1; and dated 05.12.2022 in Na.Ka.No.14122/2022/MCF1, by taking over the roads in the regularized layout for maintenance in accordance with the provisions of the Tamil Nadu Regularization of Unapproved Plots of Layout Rules, 2017 and the relevant provisions of the Local Bodies Act and Rules, within a time frame to be fixed by this Court. 2. Heard Mr. A. Sivanu Pandian, learned counsel appearing for the petitioner, Mr. Y. Ramasamy, learned Counsel for State, who takes notice on behalf of respondent Nos.1 and 5. 3. By consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal at the stage of admission itself. 4. The learned counsel appearing for the petitioner submitted that the petitioner purchased plots in the subject layout, which was originally an unapproved layout. Subsequently, the petitioner applied for regularization under the Tamil Nadu Regularization of Unapproved Plots of Layout Rules, 2017, and the second respondent passed various proceedings granting regularization. However, according to the petitioner, 199 plots have not been effectively brought within the regularized layout, as the roads in the layout have not been taken over by the concerned local body. 5. The learned counsel further submitted that under G.O.(Ms).No.78, Housing and Urban Development Department, dated 04.05.2017, read with 4/8 https://www.mhc.tn.gov.in/judis W.P(MD)No.18520 of 2026 Rule 8(c) of the Tamil Nadu Regularization of Unapproved Plots of Layout Rules, 2017, once the layout is regularized, the roads are required to be taken over suo motu by the concerned local body for maintenance. Though the petitioner has been continuously approaching respondent Nos.2 to 5 from the year 2018 by submitting several representations requesting implementation of Rule 8(c), no effective action has been taken till date. Hence, the petitioner has approached this Court. 6. The learned Counsel for State appearing for respondent Nos.1 and 5, on instructions, submitted that if the petitioner submits a fresh representation enclosing copies of all the proceedings relied upon in the writ petition, the same will be forwarded to the competent authority for appropriate consideration. He further submitted that the competent authority will examine the petitioner's request in the light of Rule 8(c) of the Tamil Nadu Regularization of Unapproved Plots of Layout Rules, 2017 and the relevant Government Orders, and appropriate orders will be passed, if there is no legal impediment. 5/8 https://www.mhc.tn.gov.in/judis W.P(MD)No.18520 of 2026 7. Considering the limited prayer sought for by the petitioner and without expressing any opinion on the merits of the claim, this Court directs the petitioner to submit a fresh representation, enclosing copies of all the relevant proceedings and this order, to the second respondent within a period of one week from the date of receipt of a copy of this order. 8. On receipt of such representation, the second respondent shall consider the same on its own merits, verify the applicability of Rule 8(c) of the Tamil Nadu Regularization of Unapproved Plots of Layout Rules, 2017 and the relevant Government Orders, afford an opportunity of hearing to the petitioner, if necessary, and pass appropriate orders in accordance with law, if there is no legal impediment, within a period of four weeks thereafter. 9. Accordingly, this Writ Petition stands disposed of.
