07.10.2026 Item no. 14 Ct. No.237 AKG
C.R.R. 4273 of 2026 Rabindra Narayan Roy & Ors. Vs. The State of West Bengal & Anr.
Mr. Supratic Roy, Mr. Subhamoy Patra, Ms. Mahuya Maity
…for the Petitioners Mr. Kallol Mondal, Ld. P. P. Mr. Subir Ganguly …for the State
Though the instant revisional application has been filed seeking quashing of the proceedings in G.R. Case No. 2534 of 2019, arising out of Tamluk Police Station Case No. 716 of 2019 dated November 26, 2019, pending before the learned Judicial Magistrate, 1st Class, 3rd Court, Tamluk, Purba Medinipur, at the time of hearing of this application, the learned advocate appearing for the petitioners has confined his submissions to the limited prayer for expeditious disposal of the said proceeding. The petitioners are the accused in the said case. It is submitted before this Court that, although the charge- sheet was filed in the said case on December 30, 2019, there has been no substantial progress in the trial till date. Out of five witnesses cited in the charge-sheet, not a single witness has been examined thus far. It is further submitted that, as far back as on January 30, 2023, the learned Magistrate had fixed November 1,
2 2023 for recording the evidence of Prosecution Witness No. 1. However, till date, no evidence has been recorded. Even on June 2, 2025, the learned Magistrate again fixed October 7, 2026 as the next date for recording the evidence of Prosecution Witness No. 1. I find substance in the submission made by the learned advocate appearing for the petitioners. In view of the aforesaid facts and circumstances, the instant revisional application is disposed of with a direction upon the learned Magistrate in the Court below to make all endeavour to conclude the trial at the earliest possible opportunity, preferably within a period of one year from the date of communication of this order, without granting any unnecessary adjournment to either of the parties. Accordingly, CRR 4273 of 2026 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
