For Petitioner : Mr.S.Veerapandiselvaraj For Respondents : Mr.M.Dinesh Hari Sudarsan Counsel for the Government of Tamil Nadu 2/7 https://www.mhc.tn.gov.in/judis W.P(MD) No.18792 of 2026 ORDER This writ petition has been filed seeking writ of Mandamus directing the respondents herein to remove the wrong entry made in the service book of petitioner's deceased father namely, Aathan, Sanitary Inspector under the control of 3rd respondent and to make necessary entry of petitioner name as well as his sisters name, so as enable to get compassionate appointment as well as drawal of family pension and other monetary benefits by considering petitioner representation dated 06.04.2026. 2. The grievance of the petitioner is that his name was not entered in the service register of his deceased father erroneously and instead the name of the second wife of the petitioner’s father was entered, thereby disabling the petitioner from making a claim for compassionate appointment and to claim other benefits consequent upon the demise of his father. 3/7 https://www.mhc.tn.gov.in/judis W.P(MD) No.18792 of 2026 3. The father of the petitioner was worked as a Sanitary Inspector in 3rd respondent office, passed away while in service on 18.06.2025. The legal heir certificate obtained by the petitioner was disclosed the name of the petitioner herein as unmarried son and the name of the second wife of the petitioner’s deceased father also shown as one of the legal heirs. Mere non-mentioning of the name of the petitioner as nominee in the service register, did not disentitle the petitioner to make a claim for any other benefit for which otherwise the petitioner is entitled to under law being the son of the deceased employee. It is not only the petitioner, all other legal heirs of deceased employee are entitled to workout their remedies in accordance with law. 4. In the circumstances, this Court is not inclined to issue Mandamus as sought for in the present writ petition either to remove the name of the second wife of petitioner’s father or to include the name of the petitioner as nominee in the service register. 4/7 https://www.mhc.tn.gov.in/judis W.P(MD) No.18792 of 2026 5. The inclusion of nominee in the service register is at the sole discretion of the deceased employee, which the deceased employee has already exercised while he was alive. Therefore, the question of issuing direction to enter the name of the petitioner as nominee of the deceased employee, after the demise of the deceased employee does not arise. Hence, the relief as sought in the present writ petition cannot be granted. However, it is always open for the petitioner to make a claim either for compassionate appointment or for any other benefits for which he is otherwise legally entitled, too, without reference to the fact that his name was not entered in the service register as nominee. 6. Accordingly, subject to the above observations, this writ petition is disposed of.
