It could be seen from the records that the petitioner has received only a pre-cognizance notice as contemplated under Section 223(1) of BNS and in such circumstances, any objection with regard to the maintainability of the private complaint has to be raised by the petitioner before the concerned Court. 3. So far, the trial Court has not taken cognizance of the alleged offenses. In such circumstances, this Court is not inclined to interfere at the pre-cognizance notice stage. Preserving the rights of the petitioner, the criminal original petition stands disposed of. No costs.
