07.10.2026 Item no. 17 Ct. No.237 AKG C.R.R. 4277 of 2026 Atindra Narayan Roy & Ors. Vs. The State of West Bengal & Anr. Mr. Supratic Roy, Mr. Subhamoy Patra, Ms. Mahuya Maity …for the Petitioners Mr. Kallol Mondal, Ld. P. P. Mr. Subir Ganguly …for the State Though the instant revisional application has been filed seeking quashing of the proceedings in G.R. Case No. 3044 of 2022, arising out of Tamluk Police Station Case No. 935 of 2022 dated October 13, 2022, pending before the learned Chief Judicial Magistrate, Tamluk, Purba Medinipur, at the time of hearing of this application, the learned advocate appearing for the petitioners has confined his submissions to the limited prayer for expeditious disposal of the said proceeding. The petitioners are the accused in the said case. It appears that there are seven prosecution witnesses in the said case. It is submitted before this Court that the charge-sheet was filed in the said case on November 30, 2022. It is further submitted by the learned advocate appearing for the petitioners that, although the learned Magistrate in the Court below, by an order dated May 14, 2025, fixed July 2, 2026 for recording the 2 evidence of Prosecution Witness No. 1, after a lapse of about fourteen months, no evidence could be recorded as the said witness was not present. It is further submitted that, till date, none of the prosecution witnesses has been examined. I find substance in the submission made by the learned advocate appearing for the petitioners. In view of the aforesaid, I find no justification in keeping the instant revisional application pending. Accordingly, the instant revisional application is disposed of with a direction upon the learned Magistrate in the Court below to make all endeavour to conclude the trial at the earliest possible opportunity, preferably within a period of one year from the date of communication of this order, without granting any unnecessary adjournment to either of the parties. Accordingly, CRR 4277 of 2026 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
