In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Nabadwip P.S case no. 502 of 2019 dated 8/11/2019 under sections 494/307/504/506/120B of the IPC. 1. Heard the learned counsels for the parties.
2. Perused the case diary.
3. The FIR was registered after a direction was passed by the learned Magistrate to register one. The prime allegation is that the petitioner is the paramour of the de- facto complainant’s wife. When no one was in the house, he came inside and tried to strangle the lady’s 10 year old child. However, there is no injury report present in the case diary.
4. Considering the above and the other materials available in the case diary and the fact that charge-sheet has been submitted, while I am inclined to grant anticipatory bail to the petitioner his movement needs to be restricted for a limited period.
5. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two

sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall not threaten or intimidate the witnesses. The petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date. The petitioners shall regularly attend the jurisdictional Court and shall stay outside the jurisdiction of Nabadwip Police Station for a period of four months except for meeting the I.O or attending the jurisdictional Court.
6. Accordingly, the application for anticipatory bail is allowed.
7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
