O.P.(MD) No.13141 of 2026, PRAYER: To direct the respondent no.1 and 2 to transfer the investigation from the respondent No. 4 respondent no.3 in Crime No. 668 of 2015 on the file of the respondent No.4 police station and to file the final report and subsequently direct the respondents to provide adequate compensation to the petitioner by considering the petitioner's representation dated 19.06.2026. For petitioner : Mr.S.M.A.Jinnah For Respondents : Mr.B.Arun Counsel for State of TN (Crl.Side) ORDER The present petition has been filed by the de-facto complaint in Cr.No. 668 of 2015, on the file of the 4th respondent police, seeking to transfer the said investigation to the 3rd respondent and to file a final report. A further prayer has also been sought for to provide an adequate compensation to the petitioner, based upon his representation dated 19.06.2026. 2. According to the learned counsel appearing for the petitioner, when she was carrying 15 sovereigns of Jewel in her bag while traveling from Madurai to Karaikudi, on the way, somebody has committed theft of the jewels and 2/6 https://www.mhc.tn.gov.in/judis Crl. O.P.(MD) No.13141 of 2026, therefore, a complaint has been lodged. However, for the past 11 years there is no progress in the investigation and therefore, seeks transfer. 3. In the meantime, the petitioner also seeks a prayer for granting of compensation based upon the orders of this Court in Crl.O.P.(MD).No.10290 of 2025 dated 25.11.2025. 4. Per contra, learned counsel for State of Tamil Nadu (Crl.Side) appearing for the respondent submits that the complaint was lodged belatedly after a period of four days from the date of incident and when the offence is said to have taken place in between Madurai and Karaikudi, it was very difficult to trace the accused persons and hence, there is some delay on his part. He further submits that they are contemplating to file an undetectable report before the concerned Court. 5. For the past 11 years, the 4th respondent is not able to identify the accused persons and they were not able to show any progress in the investigation. In such circumstances, this Court is of the considered opinion that the investigation could be transferred to the 3rd respondent. 7. In such view of the matter, the investigation in Cr.No.668 of 2015, pending on the file of the 4th respondent is transferred to the file of the 3rd respondent. The 3rd respondent is directed to conduct an investigation and file a final report, within a period of four months from the date of receipt of copy of this order.
