By filing the present petition under Article 226 of the Constitution of India, the petitioner seeks issuance of a direction to respondent No.4 to take a decision on the application dated 27.05.2024 (Annexure -P/3) submitted by the petitioner. 2. Learned counsel for the petitioner submits that respondent No.5, being a Police Constable, purchased the disputed property, which is the subject RUKHSAR BANO Digitally signed by RUKHSAR BANO Date: 2026.03.03 17:29:19 +0530 2 matter in Civil Suit No.36A/2014 (Shavishankar @ Shivshankar & Ors. vs. Lakhan @ Bukhau), which is pending consideration before the Civil Judge, Class-2, Ambikapur, and that too, without obtaining permission of the competent authority, which is in violation of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966 (for short “CCA Rules”). She further submits that the petitioner filed an application (Annexure -P/3) before respondent No.4, but the same has not been decided yet. Hence, learned counsel prays that, at this stage, the present petition may be disposed of with a direction to respondent No.4 to take an appropriate decision on the said application (Annexure -P/3). 3. Learned counsel for the State/Respondent Nos.1 to 4 submits that respondent No.4 shall take an appropriate decision on the application (Annexure -P/3) filed by the petitioner in accordance with law. 4. Having considered the limited prayer made by learned counsel for the petitioner, the present writ petition is disposed of at this stage directing respondent No.4, the Superintendent of Police, Ambikapur, Districrt Surguja, to take an appropriate decision on the application dated 27.05.2024 (Annexure -P/3) in accordance with law/applicable rules. 5. With the aforesaid observations and directions, the writ petition stands disposed of. 6. Pending interlocutory applications, if any, also stands disposed of. No order as to cost(s).
