The case of the prosecution is that the petitioner herein was earlier arrested and released on bail. Subsequently, he jumped out the bail on 18.05.2026, which resulted in issuance of non bailable warrant. Subsequently, it was executed on 02.06.2026 and is in custody. 3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. Due to illness the petitioner was not able to appear before the trial Court and now he is ready to co-operate with the trial process. Hence, he prayed bail for the petitioner. 4. The learned Counsel appearing for the State reiterated the prosecution case and reported that the petitioner herein has jumped out of bail. When the victim was about to examine and only with a view to delaying the trial process, he was absconded and subsequently, arrested by the respondent police. He opposed the grant of bail to the petitioner. 5. This Court heard both sides and perused the materials available on 2/4 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.12587 of 2026 records, which reveals that on the date of examination of the victim child, the petitioner absconded, hence, the non bailable warrant was issued. The prosecution side witnesses are to be examined from 06.07.2026 to 10.07.2026. At this stage, it the petitioner was released on bail, he will hamper the trial process. Hence, this Court is not inclined to grant bail at this stage. 6.Accordingly, this criminal original petition stands dismissed.
